SAHRASAFAR GROUP INC — Online Travel Agency

IMPORTANT — PLEASE READ CAREFULLY. THESE TERMS CONTAIN A BINDING ARBITRATION CLAUSE AND CLASS ACTION WAIVER (SECTION 22), LIMITATIONS OF LIABILITY (SECTION 17), AND DISCLAIMERS OF WARRANTIES (SECTION 16). BY ACCESSING OR USING THE PLATFORM, MAKING A BOOKING, OR CLICKING "I AGREE," YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE, DO NOT USE THE PLATFORM.

1. DEFINITIONS

"Platform" means the SahraSafar website at https://www.sahrasafar.com, all subdomains (including hotels.sahrasafar.com), mobile applications, APIs, and related digital interfaces operated by SAHRASAFAR GROUP INC.

"SahraSafar," "we," "us," or "our" means SAHRASAFAR GROUP INC.

"User," "you," or "your" means any individual who accesses, browses, or uses the Platform, whether as a registered account holder or as a guest.

"Direct Services" means travel services that are booked, paid for, and managed directly on the Platform. As of the effective date, Direct Services consist exclusively of flight bookings.

"Partner Services" means travel services for which the Platform facilitates search and comparison, but where the booking, payment, and fulfillment are completed on a third-party partner website. Partner Services include but are not limited to hotel bookings (via hotels.sahrasafar.com, powered by our whitelabel hotel partner), activities and experiences (via third-party activity providers), eVisa services, and eSIM services.

"Travel Service Provider" or "Supplier" means the airline, hotel, tour operator, activity provider, or other third party that provides the underlying travel product or service.

"Booking" means a reservation, purchase, or order of travel services initiated through the Platform.

"Hala AI" means our AI-powered travel assistant available to registered Users.

"Affiliate" or "Travel Agent" means an independent individual or entity enrolled in the SahraSafar affiliate or travel agent program.

"Content" means all text, images, graphics, software, data, designs, trademarks, logos, and materials on or accessible through the Platform.

2. ACCEPTANCE OF TERMS

2.1 How You Accept

You accept these Terms by any of the following actions, whichever occurs first:

  1. Creating an account on the Platform;
  1. Completing a Booking as a guest (by proceeding past the checkout page where "By continuing, you agree to our Terms & Conditions and Privacy Policy" is displayed);
  1. Clicking any "I agree," "Continue," or similar acceptance mechanism;
  1. Otherwise accessing or using the Platform.

2.2 Guest Users

You do not need an account to make a flight Booking on the Platform. If you complete a Booking as a guest, you are bound by these Terms to the same extent as a registered User. Your email address and phone number provided at checkout will serve as your identifiers for all communications regarding your Booking.

2.3 Booking on Behalf of Others

If you make a Booking on behalf of other travelers, you represent and warrant that: (a) you have obtained their authorization to act on their behalf; (b) you have informed them of the terms that apply to the Booking, including these Terms, the airline's conditions of carriage, and any applicable cancellation policies; (c) you have ensured they agree to such terms; and (d) you accept responsibility for all payments, communications, changes, and cancellations relating to the Booking. All information provided for other travelers must be accurate and match their travel documents.

2.4 Capacity

You represent and warrant that you are at least eighteen (18) years old and possess the legal capacity to enter into binding contracts. If you act on behalf of a legal entity, you represent that you have the authority to bind that entity.

2.5 Modifications

We may modify these Terms at any time. Material changes will be communicated via email or a prominent notice on the Platform. Continued use after changes are posted constitutes acceptance. If you disagree, discontinue use of the Platform.

3. ACCOUNT REGISTRATION AND SECURITY

3.1 Account Creation

You may register using your email address, phone number, or a third-party provider (Google Sign-In or Apple Sign-In). During registration, you agree to provide your first name, last name, and choose a username. By registering, you agree to:

  1. Provide truthful, accurate, and complete information;
  1. Keep your account information current;
  1. Maintain the security of your login credentials, including OTP codes;
  1. Notify us immediately at support@sahrasafar.com of any unauthorized access;
  1. Accept sole responsibility for all activity under your account.

3.2 Passwordless Authentication

The Platform uses a passwordless, OTP-based (one-time password) authentication system as the primary sign-in method. While a password is set during registration as an additional security layer, your primary access is through OTP codes sent to your registered email or phone number.

3.3 Account Restrictions

Each individual may maintain only one (1) active account. Your name and username cannot be changed after account creation. We reserve the right to merge, suspend, or terminate duplicate or inactive accounts.

3.4 Account Deletion

You may delete your account through Account Settings. Upon deletion: (a) your account and all associated personal data will be permanently removed in accordance with our Privacy Policy; (b) all unused loyalty points will be forfeited; (c) any pending or confirmed Bookings will remain subject to the applicable airline's terms; (d) this action is irreversible.

3.5 SahraSafar Will Never Ask for Your OTP

SahraSafar will never contact you to request your OTP code or password. Any person or message asking for this information is not from SahraSafar and should be reported to support@sahrasafar.com.

4. NATURE OF SERVICES — INTERMEDIARY STATUS

4.1 SahraSafar as Intermediary

SahraSafar is a technology platform that facilitates travel bookings. SahraSafar is not an airline, hotel, tour operator, or travel insurer. We do not own, operate, manage, or control any aircraft, hotel, vehicle, tour, or activity.

4.2 Direct Services (Flights)

For flight Bookings made directly on the Platform, SahraSafar facilitates the Booking between you and the airline via our flight data and booking partner. When you complete a flight Booking, you enter into a contract of carriage directly with the operating airline. SahraSafar acts as an intermediary facilitating that transaction. You will receive two reference numbers:

  1. A SahraSafar reference (format: FL-XXXXXXX) — for use when contacting our support;
  1. An airline reference — for use with the airline directly (check-in, manage booking, etc.).

By completing a flight Booking, you agree to the airline's conditions of carriage, which govern the flight itself.

4.3 Partner Services (Hotels, Activities, eVisa, eSIM, and Others)

For hotels, activities, and other Partner Services, the Platform provides search and comparison functionality only. When you select a hotel or activity, you are redirected to a third-party partner website (including hotels.sahrasafar.com, which is a whitelabel partner site) to complete your booking.

Critical distinctions for Partner Services:

  1. Your booking, payment, and personal data are processed entirely by the partner, not by SahraSafar;
  1. Partner Service bookings do NOT appear in your SahraSafar account;
  1. SahraSafar has NO ability to view, modify, cancel, or refund Partner Service bookings;
  1. All support, cancellations, refunds, and disputes for Partner Services must be directed to the partner provider;
  1. The partner's own terms and conditions, privacy policy, and cancellation policy govern your booking.

SahraSafar disclaims all liability for Partner Services. Our role is limited to providing the search and comparison interface.

4.4 No Agency Relationship with Suppliers

SahraSafar does not act as an agent, representative, or fiduciary of any airline, hotel, or activity provider. Display of any Travel Service Provider's offerings on the Platform does not constitute endorsement, recommendation, or guarantee.

5. BOOKING AND PAYMENT — DIRECT SERVICES (FLIGHTS)

5.1 Booking Process

When you submit a flight Booking, you make an offer to purchase air transportation from the applicable airline. A Booking is confirmed only when you receive a confirmation email from SahraSafar or see a confirmed status on-screen. Until then, no binding contract exists.

5.2 Fare Expiration

Flight fare offers are dynamic and subject to real-time availability. Fare offers expire approximately every ten (10) minutes. If you see a message indicating your selected trip has expired, the fare is no longer available. You must search again for current availability and pricing. SahraSafar is not liable for expired fares or price changes.

5.3 Pricing

All prices are subject to availability and may change at any time before Booking confirmation. Prices are set by airlines and their distribution systems, not by SahraSafar. We do not guarantee that any displayed price will remain available.

5.4 Currency Display and Payment Currency

The Platform allows you to browse in multiple currencies for convenience. However, all payments are processed exclusively in United States Dollars (USD). The prices you see in your selected display currency are converted from USD using current exchange rates provided by third-party currency data services. The actual charge to your payment method will be in USD.

Your bank or card issuer may convert the USD charge to your local currency at their own exchange rate and may apply cross-border or foreign transaction fees. These bank-imposed charges are your responsibility and are outside SahraSafar's control.

Prices displayed in currencies other than USD are estimates provided for convenience only. The exact USD amount to be charged is displayed at checkout before you submit payment.

5.5 Fees and Price Transparency

Two fees are added to every flight Booking:

  1. Processing fee — covers payment processing costs;
  1. Convenience fee — covers SahraSafar's booking service.

Both fees are disclosed on the checkout page before you submit payment and are included in the Grand Total displayed. You will see the base airfare, taxes, processing fee, and convenience fee itemized before confirming your Booking. Both fees are non-refundable, even if the underlying flight is cancelled and refunded by the airline. No additional mandatory fees will be charged after checkout.

5.6 Payment Processing

Payments are processed through Stripe. By submitting payment, you authorize SahraSafar, through Stripe, to charge the total amount in USD. You represent that you are authorized to use the payment method provided. We accept Visa, Mastercard, American Express, and Discover.

5.7 Payment Data

SahraSafar does not store your full card number, CVV, PIN, or other sensitive payment data. Stripe handles all card processing as a PCI-DSS Level 1 certified processor. We retain only the last four (4) digits and card network for display and support purposes.

5.8 Payment Flow

You pay SahraSafar. SahraSafar pays the airline through our flight booking partner. You do not pay the airline directly.

5.9 Pricing Errors

If a manifest pricing error occurs (e.g., fares significantly below market rates due to system errors), SahraSafar reserves the right to cancel affected Bookings even after confirmation. We will notify you and offer either a rebook at the correct price or a full refund.

5.10 Failed Payments

If payment fails, declines, or cannot be processed, the Booking will not be confirmed. SahraSafar is not responsible for consequences of failed payments, including fare increases or loss of availability.

6. CANCELLATIONS AND REFUNDS — DIRECT SERVICES (FLIGHTS)

6.1 How to Cancel

You may cancel a flight Booking by:

  1. Using the Manage Booking feature on the Platform — enter your SahraSafar reference (FL-XXXXXXX) and an adult passenger's last name; or
  1. Contacting support at support@sahrasafar.com.

You may cancel an entire Booking or select individual flights within a Booking.

6.2 Refund Eligibility

Refund amounts are determined solely by the airline and the fare type you booked:

  1. Full refund — available on some airlines and fare types;
  1. Partial refund — airline deducts a cancellation fee;
  1. No refund — fare is non-refundable.

The refund amount is displayed when you initiate cancellation. SahraSafar's processing fee and convenience fee are non-refundable in all cases.

6.3 Refund Processing

Approved refunds are processed back to your original payment method. SahraSafar cancels the flight through our booking partner, and the refund typically takes seven (7) business days for credit card purchases and twenty (20) calendar days for other payment methods to appear, in accordance with U.S. Department of Transportation regulations.

6.4 Airline-Initiated Cancellations and Significant Changes

If an airline cancels your flight or makes a significant change (as defined by DOT regulations, including domestic arrival delays of 3+ hours or international delays of 6+ hours), you are entitled to a refund of the airfare if you choose not to accept alternative transportation or travel credits offered by the airline. In such cases, SahraSafar will notify you of your right to a full cash refund and facilitate the refund process. Airlines may not substitute vouchers or credits for a cash refund unless you affirmatively choose to accept them. SahraSafar's processing fee and convenience fee remain non-refundable even in cases of airline-initiated cancellations.

6.5 Airline Credit

Some airlines offer travel credit instead of cash refunds for voluntary cancellations. SahraSafar does not currently support airline credit. If your fare qualifies for credit only, you must claim it directly on the airline's website using your airline reference number.

6.6 Flight Changes

SahraSafar does not currently support flight changes or modifications. If you need to change your flight (dates, times, routes, passenger details), you must contact the airline directly using your airline reference number. The airline may charge change fees. Alternatively, you may cancel and rebook through SahraSafar, subject to the cancellation and refund policies above.

6.7 Booking Mistakes and Name Corrections

If you entered incorrect passenger information:

  1. Contact us at support@sahrasafar.com immediately with your Booking reference and a description of the error;
  1. If we cannot correct the issue, contact the airline directly — airlines often have flexibility for minor name corrections;
  1. If neither SahraSafar nor the airline can correct the error, you may need to cancel and rebook, subject to cancellation policies.

You are solely responsible for ensuring that passenger names match travel documents exactly. SahraSafar is not liable for denied boarding or additional charges resulting from errors in information you provided.

6.8 Chargebacks

You agree to contact SahraSafar at support@sahrasafar.com before initiating any chargeback, payment reversal, or dispute with your bank or card issuer. We take payment disputes seriously and commit to resolving issues promptly. If you initiate a chargeback without first contacting us, SahraSafar reserves the right to: (a) suspend or permanently ban your account; (b) pursue recovery of the disputed amount plus associated fees; (c) report fraudulent chargeback activity to relevant authorities; and (d) engage collection remedies as permitted by law. Users identified as engaging in fraudulent chargeback activity will be permanently banned from the Platform.

7. PARTNER SERVICES — HOTELS, ACTIVITIES, AND TRAVEL EXTRAS

7.1 Scope of SahraSafar's Role

For all Partner Services (hotels via hotels.sahrasafar.com, activities via third-party providers, eVisa, eSIM, and any future Partner Services), SahraSafar's role is limited exclusively to providing a search and comparison interface. SahraSafar is not a party to any booking, payment, or contract you enter into with a partner provider.

7.2 Redirect Disclosure

When you select a hotel, activity, or other Partner Service, you are redirected to the partner's website to complete your booking. Although hotels.sahrasafar.com uses SahraSafar branding, it is operated by our whitelabel hotel partner, and all bookings, payments, and data processing on that site are governed by the partner's terms — not SahraSafar's.

7.3 No SahraSafar Liability

SahraSafar expressly disclaims all liability for Partner Services, including but not limited to:

  1. The accuracy of descriptions, pricing, ratings, photographs, or availability displayed on the Platform;
  1. The quality, safety, or suitability of hotels, activities, or other services;
  1. Cancellations, modifications, refunds, or customer service failures by the partner;
  1. Loss of personal data or payment data processed by the partner;
  1. Any injury, illness, death, property damage, or financial loss arising from Partner Services.

7.4 Partner Support

For any issue with a Partner Service booking — including cancellations, refunds, changes, or disputes — you must contact the partner provider directly. SahraSafar is unable to access, view, modify, or cancel Partner Service bookings.

8. TRAVELER RESPONSIBILITIES

8.1 Travel Documents

You are solely responsible for obtaining valid passports, visas, entry permits, health certificates, vaccination records, and all other documentation required for your journey. SahraSafar does not guarantee the accuracy or completeness of any travel document information displayed on the Platform. Entry requirements change frequently, and you must verify them through official government sources.

8.2 Accuracy of Booking Information

You must ensure that all information provided during Booking — including passenger names, dates of birth, nationality, and contact details — is accurate and matches your official travel documents. Passenger names must exactly match the name on the traveler's passport or ID. Errors may result in denied boarding, entry refusal, or additional charges for which SahraSafar bears no responsibility.

8.3 Travel Insurance

SahraSafar strongly recommends comprehensive travel insurance. We do not sell or provide travel insurance and are not responsible for losses that could have been mitigated by insurance.

8.4 Children and Infants

Bookings involving minors must be made by an accompanying adult. Age categories are determined by the traveler's age on the date of each flight: infants (under 2), children (2–11), adults (12+). Each infant must be assigned to one adult passenger. If a child's birthday falls during a trip, separate one-way tickets may be required.

8.5 Health, Safety, and Compliance

You are responsible for complying with all health requirements, travel advisories, and the laws of your countries of departure, transit, and destination, as well as the policies of all Travel Service Providers.

9. HALA AI — AI TRAVEL ASSISTANT

9.1 Availability and AI Disclosure

Hala AI is available to registered Users only and is accessible 24/7 via the chat icon on the Platform. Hala AI is an artificial intelligence system, not a human. When you interact with Hala AI, you are communicating with an automated AI-powered system. No human reviews or monitors your conversations in real time.

9.2 Data Shared with AI Provider

When you use Hala AI, the following data is sent to our AI provider (OpenAI) for processing: your first name, username, and email address; your conversation messages; and any stored contextual memories from prior conversations. Do not share sensitive personal information (such as passport numbers, payment details, or government ID numbers) in Hala AI conversations. We employ a custom content filter that warns Users who attempt to share sensitive information.

9.3 No Professional Advice

Hala AI is powered by artificial intelligence and may produce incorrect, incomplete, outdated, or misleading information. Hala AI responses do not constitute professional travel, legal, medical, financial, or any other form of advice. You must independently verify all critical information through official sources.

9.4 Data Storage and Deletion

Hala AI conversations and contextual memories are stored in our database. You may delete your conversation history and memories at any time through your account settings or by contacting support@sahrasafar.com.

9.5 Limitation of Liability

SahraSafar shall not be liable for any decisions, actions, or losses resulting from information provided by Hala AI.

10. ZYRAH CIRCLE — LOYALTY PROGRAM

10.1 Overview

The SahraSafar loyalty program is called Zyrah Circle and consists of three tiers: Oasis (entry), Caravan (mid), and Sultan (top). Points ("Zyrah Points") are earned and tiers are advanced through qualifying Bookings. Detailed terms governing the Zyrah Circle program are set out in the Zyrah Circle Terms and Conditions, which are incorporated by reference into these Terms. In the event of any conflict between this Section and the Zyrah Circle Terms and Conditions, the Zyrah Circle Terms and Conditions prevail.

10.2 Earning Points

Zyrah Points are earned exclusively on completed flight Bookings made directly on the Platform. Hotel bookings, Partner Service bookings, and cancelled flights do not earn points. Points are credited after the Booking is confirmed. Tier multipliers (1x for Oasis, 1.25x for Caravan, 1.5x for Sultan) apply based on your current tier. Cabin class multipliers also apply (1x Economy, 1.25x Premium Economy, 1.5x Business, 2x First). Promotional route multipliers may apply during limited-time offers.

10.3 Tier Benefits

Higher tiers unlock benefits including: priority support (Sultan); enhanced Hala AI features and voice AI support (Caravan and Sultan); and access to exclusive deals and promotions (all tiers). Full details of tier benefits are set out in the Zyrah Circle Terms and Conditions.

10.4 Refunds and Points

If a flight Booking is cancelled and refunded, the Zyrah Points earned from that Booking will be deducted from your balance. If you have already spent some or all of those points, your balance may go negative. A negative balance will be recovered through future Bookings.

10.5 Points Expiration

Zyrah Points expire at the end of each calendar year (December 31, 23:59 UTC). Unused points that are not redeemed before expiration will be forfeited. Tier status may also be affected by point expiration.

10.6 Program Changes

SahraSafar reserves the right to modify, suspend, or terminate the Zyrah Circle program, including tier requirements, point earning rates, redemption values, benefits, and expiration policies, at any time, with reasonable notice. Material changes that substantially limit the way points are earned or redeemed will be communicated to Members with reasonable prior written notice. Changes will be communicated through the Platform or via email. Continued participation after changes constitutes acceptance.

10.7 Non-Transferable

Zyrah Points and tier status are non-transferable and may not be sold, bartered, or exchanged. Zyrah Points have no cash value and are promotional in nature. You have no property rights or other legal interests in Zyrah Points.

11. AFFILIATE AND TRAVEL AGENT PROGRAM

11.1 Independent Status

Affiliates and Travel Agents enrolled in the SahraSafar program are independent contractors, not employees, agents, or representatives of SahraSafar. Affiliates access the Platform through their own separate login and dashboard. Unless SahraSafar explicitly designates an Affiliate as an official SahraSafar office in writing, no Affiliate may represent themselves as acting on behalf of, or under the authority of, SahraSafar.

11.2 Commission and Rewards

Affiliates earn: (a) custom affiliate reward points for flight and hotel Bookings made by their referred customers; and (b) a commission of 2% of SahraSafar's commission on each qualifying Booking. Rewards may be redeemed monthly or accumulated. Reward availability and values may change.

11.3 Affiliate Obligations

Affiliates agree to: (a) provide accurate information to their customers; (b) not make false representations about SahraSafar's services; (c) comply with all applicable laws and regulations; (d) not engage in fraudulent or deceptive practices.

11.4 Termination

SahraSafar may terminate any Affiliate's participation at any time for violation of these Terms or for any reason with thirty (30) days' notice. Unredeemed points at the time of termination may be forfeited.

12. INTELLECTUAL PROPERTY

12.1 Ownership

All Content on the Platform — including website design, source code, algorithms, databases, logos, trademarks (including "SahraSafar" and "Hala AI"), and proprietary technology — is the exclusive property of SAHRASAFAR GROUP INC or its licensors, protected by applicable intellectual property laws.

12.2 Limited License

You receive a limited, non-exclusive, non-transferable, revocable license to access and use the Platform for personal, non-commercial travel planning and booking purposes only. You may not copy, modify, distribute, scrape, reverse engineer, or create derivative works from any Content.

12.3 Prohibited Uses

Without limiting the foregoing, you may not: (a) use any automated system, robot, spider, scraper, or data mining tool to access, extract, or collect data from the Platform; (b) frame, mirror, or deep-link to any part of the Platform; (c) use the Platform to build a competing product or service; (d) submit false, fraudulent, or misleading information; (e) interfere with or disrupt the Platform's infrastructure; (f) attempt to gain unauthorized access to any system, account, or data; (g) use the Platform for any unlawful purpose; or (h) resell, sublicense, or commercially exploit any Content or data without express written permission.

12.4 User Content

By submitting content to the Platform (reviews, feedback, communications), you grant SahraSafar a worldwide, royalty-free, perpetual, irrevocable, sublicensable license to use, reproduce, modify, and display that content.

13. THIRD-PARTY SERVICES

The Platform integrates with third-party services across the following categories: flight booking and distribution (Duffel); hotel search and rates (LiteAPI); activity and experience search (Viator); payment processing (Stripe); artificial intelligence (OpenAI for Hala AI); voice transcription and synthesis for Hala AI voice (ElevenLabs for speech-to-text and Fish Audio for text-to-speech); authentication and session management (Google, Apple, and SuperTokens — self-hosted); SMS and communications (Twilio); fraud prevention and geolocation (MaxMind); mapping (Mapbox); and currency exchange rates (OpenExchangeRates). Each third-party service is governed by its own terms and privacy policies. SahraSafar is not responsible for third-party service availability, accuracy, or practices. A current list of named third-party sub-processors is available upon request by emailing legal@sahrasafar.com.

14. FRAUD DETECTION AND SECURITY

14.1 Measures

SahraSafar employs self-hosted device fingerprinting, IP analysis and geolocation services (MaxMind), Stripe's fraud detection systems, velocity checking, behavioral pattern analysis, and machine learning-based bot detection models trained on aggregated Platform interaction data to protect the Platform and its Users.

14.2 Right to Decline

We may decline, hold, delay, or cancel any Booking, transaction, or account that we suspect involves fraud, unauthorized use, or illegal activity, without obligation to disclose our reasons.

14.3 Account Suspension and Bans

Accounts associated with fraudulent activity, unauthorized chargebacks, platform abuse, or conduct harmful to other Users or partners may be suspended or permanently banned at our sole discretion.

15. PRIVACY

Our collection, use, and disclosure of personal data is governed by our Privacy Policy, which is incorporated by reference. By using the Platform, you consent to the practices described therein.

16. DISCLAIMERS OF WARRANTIES

THE PLATFORM AND ALL SERVICES, CONTENT, AND MATERIALS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, RELIABILITY, OR COMPLETENESS.

SAHRASAFAR DOES NOT WARRANT THAT: (a) THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE; (b) BOOKINGS WILL ALWAYS BE SUCCESSFULLY PROCESSED; (c) PRICES WILL BE ACCURATE OR REPRESENT THE BEST AVAILABLE RATES; (d) FARE OFFERS WILL REMAIN AVAILABLE; (e) HALA AI WILL PROVIDE ACCURATE INFORMATION; (f) PARTNER SERVICES WILL MEET YOUR EXPECTATIONS; OR (g) SEARCH RESULTS WILL BE COMPREHENSIVE.

17. LIMITATION OF LIABILITY

17.1 Exclusion of Damages

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SAHRASAFAR PARTIES (SAHRASAFAR GROUP INC, ITS OFFICERS, DIRECTORS, SHAREHOLDERS, EMPLOYEES, AGENTS, AFFILIATES, AND LICENSORS) SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR ANTICIPATED SAVINGS, ARISING FROM: (a) YOUR USE OF THE PLATFORM; (b) ANY BOOKING OR TRAVEL SERVICE; (c) ANY PARTNER SERVICE; (d) HALA AI RESPONSES; (e) FARE EXPIRATIONS OR PRICE CHANGES; (f) CURRENCY CONVERSION DIFFERENCES; OR (g) THIRD-PARTY ACTS OR OMISSIONS.

17.2 Liability Cap

THE AGGREGATE LIABILITY OF THE SAHRASAFAR PARTIES FOR ALL CLAIMS SHALL NOT EXCEED THE GREATER OF: (a) THE SERVICE FEES (PROCESSING FEE + CONVENIENCE FEE) PAID TO SAHRASAFAR FOR THE SPECIFIC BOOKING GIVING RISE TO THE CLAIM; OR (b) TWO HUNDRED AND FIFTY UNITED STATES DOLLARS (USD $250).

17.3 Essential Basis

These limitations reflect a fair allocation of risk and form an essential basis of the agreement. SahraSafar would not provide the Platform without them.

17.4 Jurisdictional Variations

Some jurisdictions do not permit the exclusion of certain damages. In such cases, liability is limited to the maximum extent permitted by applicable law.

18. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless the SahraSafar Parties from all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising from: (a) your use of the Platform; (b) your violation of these Terms or any law; (c) your Bookings or travel; (d) any content you submit; (e) disputes with Travel Service Providers or partner providers; (f) unauthorized chargebacks; or (g) your negligence, fraud, or willful misconduct.

19. FORCE MAJEURE

Neither SahraSafar nor any Travel Service Provider shall be liable for failure or delay caused by events beyond reasonable control, including but not limited to: acts of God; natural disasters; epidemics, pandemics, or public health emergencies (including quarantines and government-mandated closures); war, armed conflict, or terrorism; civil unrest or insurrection; government orders, sanctions, embargoes, or travel bans; changes in law or regulation; strikes or labor disputes; power or telecommunications failures; cyberattacks or system failures; airline or airport closures; supply chain disruptions; or volcanic eruptions or severe weather events.

20. TERMINATION

20.1 By You

You may terminate your account at any time via Account Settings or by contacting support@sahrasafar.com. Termination does not relieve you of obligations for confirmed Bookings.

20.2 By SahraSafar

We may suspend or terminate your access at any time, with or without cause or notice.

20.3 Survival

Sections 4, 7, 9.5, 12, 14, 16, 17, 18, 19, 21, 22, and 23 survive termination.

21. GOVERNING LAW

These Terms are governed by the laws of the State of North Carolina, United States, without regard to conflict of law principles. To the extent any dispute is not subject to arbitration under Section 22, the exclusive venue for such proceedings shall be the state or federal courts located in the State of North Carolina. Nothing in these Terms shall limit or exclude any rights you may have under mandatory consumer protection laws of your jurisdiction, including but not limited to the North Carolina Unfair and Deceptive Trade Practices Act (N.C.G.S. § 75-1.1), to the extent such laws cannot be contractually waived.

22. DISPUTE RESOLUTION — ARBITRATION AND CLASS ACTION WAIVER

THIS SECTION AFFECTS YOUR LEGAL RIGHTS. READ IT CAREFULLY.

22.1 Informal Resolution First

Before formal proceedings, you must email support@sahrasafar.com with a description of the dispute, your name, account/Booking details, and requested relief. We will attempt resolution within thirty (30) days.

22.2 Binding Arbitration

Unresolved disputes shall be settled by binding individual arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules, or a mutually agreed provider, conducted by a single arbitrator in English. The arbitrator's decision is final and enforceable in any court.

22.3 Class Action Waiver

YOU AND SAHRASAFAR AGREE THAT DISPUTES WILL BE RESOLVED ONLY ON AN INDIVIDUAL BASIS. NEITHER PARTY MAY BRING OR PARTICIPATE IN ANY CLASS, COLLECTIVE, CONSOLIDATED, MULTI-PARTY, OR REPRESENTATIVE ACTION. The arbitrator may not consolidate claims or preside over class proceedings. If this waiver is unenforceable as to a specific claim, that claim proceeds in court; all other claims remain in arbitration.

22.4 Jury Trial Waiver

BOTH PARTIES WAIVE THE RIGHT TO A JURY TRIAL.

22.5 Time Limitation

All disputes must be filed within one (1) year of the date the claim arose. Claims filed after one year are permanently barred.

22.6 Exceptions

Either party may seek injunctive relief for intellectual property violations in court. Small claims court remains available for qualifying claims. This Section does not apply where prohibited by the mandatory laws of your residence.

22.7 Opt-Out

You may opt out by emailing support@sahrasafar.com within thirty (30) days of first use, including your name, email, and a clear opt-out statement. If you opt out, disputes proceed in court under Section 21.

22.8 Mass Arbitration

If twenty-five (25) or more similar disputes are filed by the same counsel or coordinated group, a bellwether process applies: up to ten (10) disputes are arbitrated first, and their outcomes inform resolution of the remainder through mediation or further arbitration.

23. GENERAL PROVISIONS

Entire Agreement. These Terms, the Privacy Policy, the Cookie Policy, and any Supplemental Terms constitute the entire agreement and supersede all prior agreements.

Severability. Invalid provisions are modified to the minimum extent necessary or severed; remaining provisions continue in full force.

No Waiver. Failure to enforce any provision is not a waiver. Waivers must be in writing.

Assignment. You may not assign these Terms. SahraSafar may assign freely, including in connection with mergers or acquisitions.

No Third-Party Beneficiaries. No third-party beneficiary rights are created, except that Travel Service Providers may invoke disclaimers and liability limitations herein.

Electronic Communications. You consent to receiving notices, agreements, and disclosures electronically.

Language. The English-language version prevails over any translation.

Headings. Section headings are for convenience only.

Relationship. Nothing creates a partnership, joint venture, agency, franchise, or employment relationship.
